Nearly every week at Feltman Law Firm a potential client presents him or herself with severe immigration law consequences which were the result of poor advice from a criminal attorney. Recently the highest court in the United States made the ruling in the case of Padilla v. Kentucky that a criminal attorney MUST advise an immigrant of the consequences of a criminal conviction under certain circumstances. Currently there is debate about the amount of information that must be provided. But if the immigrant is not properly advised the immigrant may have the opportunity to try and reopen his criminal case.
In order to absolve the situation from arising it is very important that an immigrant be properly advised of the severe consequences of a criminal conviction. Even a simple misdemeanor conviction can result in a lifetime penalty from ever being able to return to the United States legally with a green card (permanent residency). This is true whether the immigrant has lawful status currently or not and regardless of the length the immigrant has lived in the United States.
